These Terms of Service ("Terms") govern your access to and use of the Mrs. Penky website and the purchase of products offered through it (the "Site"). By placing an order or otherwise using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

1. About Us

Mrs. Penky is an online retailer of devotional and spiritual gift items, operating primarily for customers in the Philippines and Southeast Asia. Business registration details and contact information are provided in Section 11 below.

2. Eligibility

By using the Site, you confirm that you are at least 18 years old, or are using the Site under the supervision of a parent or legal guardian, and that you have the legal capacity to enter into a binding contract.

3. Products, Pricing & Availability

• All product descriptions, images, and prices are provided as accurately as possible. Minor variations in color or finish may occur due to the materials and finish of some items.
• Prices are listed in Philippine Peso (₱) and, where applicable, US Dollar (USD), and are subject to change without prior notice. The price charged is the price displayed at the time your order is confirmed.
• We reserve the right to limit quantities, refuse an order, or discontinue a product at our discretion, including in cases of suspected fraud, pricing errors, or stock unavailability.

4. Orders & Payment

• An order is confirmed once payment has been successfully processed through an accepted payment method (including GCash, Maya, credit/debit card, or other supported channels).
• You are responsible for providing accurate shipping and contact information. We are not liable for delays or failed deliveries caused by incorrect information supplied by you.
• We take reasonable measures to protect payment information, and card or e-wallet details are processed directly by our licensed payment partners; we do not store full payment card numbers on our servers.

5. Shipping & Delivery

Estimated delivery timeframes are provided at checkout and are not guaranteed. Delays caused by couriers, customs (for international shipments within Southeast Asia), weather, or circumstances beyond our reasonable control are not our responsibility, though we will assist in tracking and resolving delivery issues where possible.

6. Returns & Refunds

Returns, exchanges, and refunds are governed by our separate Refund Policy, which forms part of these Terms.

7. Intellectual Property

All content on the Site — including text, graphics, logos, product photography, and the Mrs. Penky name and branding — is owned by or licensed to us and is protected under applicable Philippine and international intellectual property law. You may not reproduce, distribute, or create derivative works from this content without our prior written consent.

8. Consumer Protection

Nothing in these Terms limits any rights you may have as a consumer under the Consumer Act of the Philippines (Republic Act No. 7394) or other applicable consumer protection laws in your country of residence, including rights relating to product quality, accurate advertising, and remedies for defective goods.

9. Limitation of Liability

To the fullest extent permitted by law, Mrs. Penky shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Site or purchase of products, except where such liability cannot be excluded under the Consumer Act of the Philippines or other mandatory applicable law.

10. Governing Law

These Terms are governed by the laws of the Republic of the Philippines, without regard to conflict-of-law principles. Any disputes shall first be addressed through good-faith negotiation, and if unresolved, submitted to the courts or appropriate consumer arbitration body having jurisdiction in the Philippines.

11. Changes to These Terms

We may update these Terms from time to time. Changes take effect once posted on this page, with the "Last updated" date revised accordingly. Continued use of the Site after changes constitutes acceptance of the updated Terms.
